Litigation

Dr. Wilkening’s practice focuses on intellectual property litigation, with an emphasis on patent infringement suits arising under the Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act and Biologics Price Competition and Innovation Act (BPCIA).

Dr. Wilkening has experience representing clients in proceedings before the U.S. Patent and Trademark Office (USPTO), U.S. District Courts, and the U.S. International Trade Commission (ITC). She is involved in all stages of litigation, including pre-suit investigations, discovery, expert reports, motion practice, and strategic counseling related to Paragraph IV certifications. She also provides due diligence assessments concerning patentability, freedom-to-operate, infringement, and invalidity.

With a Ph.D. in chemistry and a strong background in patent prosecution, Dr. Wilkening brings deep technical knowledge to her litigation work, particularly in pharmaceutical, chemical, medical device, and life sciences technologies. Her experience includes working with a variety of clients—from multinational pharmaceutical companies to research institutions—and advising on a wide range of intellectual property matters.

Previous Experience

Prior to joining Rakoczy Molino Mazzochi Siwik LLP as an associate, Dr. Wilkening was an associate at Merchant & Gould, P.C. and a patent agent and associate at Troutman Pepper Hamilton Sanders LLP.  She also held licensing positions at Emory University and Georgia Tech, where she negotiated research and commercial agreements and evaluated early-stage technologies for patent protection and commercialization.
