Litigation
Ms. Neubauer’s practice focuses on intellectual property litigation, with an emphasis on patent infringement suits arising under the Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act.
Ms. Neubauer has experience assisting in the representation of clients in proceedings before multiple U.S. District Courts and the Federal Circuit Court of Appeals. She has experience in all stages of litigation, including pre-suit investigation work and pleadings practice, fact and expert discovery, dispositive motion practice, and the pretrial, trial, and appellate phases of federal litigation. She also has experience representing clients before the U.S. Patent and Trademark Office and the Patent Trial and Appeal Board.
Ms. Neubauer has experience representing clients in matters spanning a wide range of technologies, including pharmaceuticals and diagnostic tests, including with respect to biosimilar drug products, injectable dosage forms, ophthalmic dosage forms, and manufacturing and analytical processes and methods associated with the same. She also has experience with a variety of medical device technologies, including cardiac, ophthalmic, neurologic, and orthopedic implants and surgical tools.
