Litigation

Mr. Bortz’s practice focuses on intellectual property litigation, with emphasis on patent infringement suits arising under the Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act and Biologics Price Competition and Innovation Act (BPCIA).

Mr. Bortz has experience assisting in the representation of clients in proceedings before U.S. District Courts, the U.S. Patent and Trademark Office, and the International Trade Commission. He also has experience in all stages of litigation, including pre-suit investigation work and pleadings practice, fact and expert discovery, dispositive motion practice, and the pretrial and trial phases of federal litigation and arbitration.

Mr. Bortz has experience with various pharmaceutical technologies, including pharmaceutical formulations, polymorphic forms of active pharmaceutical ingredients, and analytical processes.

Previous Experience

Prior to joining Rakoczy Molino Mazzochi Siwik LLP as an associate, Mr. Bortz was an associate in the intellectual property litigation group at Ropes & Gray LLP. Prior to law school, Mr. Bortz worked for the Wisconsin Department of Transportation – Chemical Test Section as a breath alcohol toxicologist and chemist, working as a member of the statewide breath alcohol testing program and testifying as an expert witness in state and federal courts across Wisconsin.
