Ms. Whitacre’s practice focuses on intellectual property litigation, with emphasis on patent infringement suits arising under the Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act and Biologics Price Competition and Innovation Act (BPCIA).
Ms. Whitacre has litigated a broad range of pharmaceutical, chemical, and biotechnology matters, including cases involving drug formulations, methods of use, and analytical processes. She pairs strong legal experience with scientific insight to provide strategic guidance that protects and advances clients ’interests in the life sciences industry. Her work spans all stages of litigation—from pre-suit investigations and pleadings through expert discovery and dispositive motion practice.
Previous Experience
Prior to joining Rakoczy Molino Mazzochi Siwik LLP as an associate, Ms. Whitacre practiced at two Am Law 100 firms in Atlanta, Georgia. She has represented pharmaceutical companies in Hatch-Waxman/Abbreviated New Drug Application (ANDA) cases, including pre-suit investigations. She has also handled patent infringement disputes involving flow cytometry and reproductive technologies, and has enforced intellectual property rights related to heart device innovations. Before entering private practice, Ms. Whitacre served as a law clerk to the Honorable Thomas Langstaff of the U.S. District Court for the Middle District of Georgia and as a law clerk for the Georgia Court of Appeals.
