Litigation

Mr. Marx has experience with a wide variety of intellectual property suits, including representing both plaintiffs and defendants in patent infringement actions and trademark infringement actions.

Mr. Marx’s current litigation practice focuses on complex patent litigation relating to the Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act. Mr. Marx’s experience extends to all aspects of federal litigation, including pre-litigation activities (preparation of patent opinions and Paragraph IV notice letters), fact and expert discovery, claim construction, pre-trial, trial, and appeal. Mr. Marx has participated in patent litigation concerning oral, nasal, and aerosol dosage forms, extended- and modified-release dosage forms, polymorphic drug substances, process development, analytical testing of drug substances and drug products, process chemistry, bioequivalence studies, methods of treatment, drug delivery systems, pharmacokinetics, and pharmacodynamics.

Opinion Work and Patent Counseling

Mr. Marx also works with clients in preparing of opinions of counsel on a variety of intellectual property issues, including non-infringement opinions and invalidity opinions on patents covering pharmaceutical products, as well as freedom to operate opinions.

Patent Prosecution

Mr. Marx is registered to practice before the United States Patent and Trademark Office and has had significant experience preparing and prosecuting patents. Mr. Marx’s experience includes a wide range of technological fields, including the mechanical arts (including medical devices), electrical arts, chemical arts, and pharmaceuticals.

Previous Experience

Prior to joining Rakoczy Molino Mazzochi Siwik LLP, Mr. Marx worked on patent litigation, patent prosecution, and trademark litigation matters at Brinks Hofer Gilson & Lione. Before attending law school, Mr. Marx worked at Harvard Medical School and Beth-Israel Deaconess Medical Center.
