Brooks A. Jones

Technical Advisor

Brooks A. Jones, who holds a Ph.D. in chemistry, is a Technical Advisor at Rakoczy Molino Mazzochi Siwik LLP.

Dr. Jones’ education in materials, analytical, and organic chemistry allows him to make valuable contributions to cases spanning a variety of technological areas, including solid forms, salt selection, dosage form design, and pharmaceutical compounds. Dr. Jones has considerable expertise with respect to solid state chemistry, including knowledge of, inter alia, crystallography, powder X-ray diffraction, thermal analysis, vibrational spectroscopy, solid-state nuclear magnetic resonance, and microscopy.

Litigation

Dr. Jones provides integral support to complex district court litigations, including Hatch-Waxman and Biologics Price Competition and Innovation Act (BCPIA) litigations. He is involved in pre-suit evaluation and strategy development in support of both non-infringement and invalidity defenses, and further aids in the identification of and consultation with experts to further develop defenses. Dr. Jones has extensive involvement during fact and expert discovery, including support for the drafting of non-infringement and invalidity contentions, as well as expert reports.

Dr. Jones is also highly skilled at data analysis and interpretation, including comprehension of reported experimental data, which is a valuable resource during litigation. He also aids in the development and evaluation of laboratory protocols and assessment of results used in support of non-infringement or invalidity defenses.

Dr. Jones additionally has considerable experience in scientific literature research and analysis. He frequently performs searches for relevant art in the chemical, biological, and medical fields and is highly practiced using several search platforms including STN and Derwent Innovation. He frequently conducts specific and general chemical structure searches, including Markush structure searches, and high-level keyword searches. He has intimate knowledge of database structure and search engine functions, making him a highly proficient searcher.

Dr. Jones has been an integral team member in support of a number of litigations relating to, inter alia, tyrosine kinase inhibitors and/or solid forms, including such drugs as Gleevec® (imatinib), Sprycel® (dasatinib), Tykerb® (lapatinib), Tasigna® (nilotinib), Inlyta® (axitinib), Invokana® (canagliflozin), Nasonex® (mometasone), Abilify® (aripiprazole), and Gabitril® (tiagabine).

Opinion Work and Patent Counseling

Dr. Jones assists with preparation of opinions in the pharmaceutical, chemical, and biological fields, including review and analysis of applicable prior art, execution of searches for relevant literature and patent materials, and construction of sound scientific arguments as part of clients’ representation. Dr. Jones is also skilled at performing intellectual property landscape searches and aiding with the preparation of freedom to operate opinions. Additionally, he assists clients in a variety of due diligence projects.

Previous Experience

Dr. Jones received a Bachelor of Science degree in Chemistry from Furman University in 2002. He received a Ph.D. in Chemistry from Northwestern University in 2007.

Prior to joining Rakoczy Molino Mazzochi Siwik LLP, Dr. Jones held a graduate research assistant position in the laboratories of Professors Tobin J. Marks and Michael R. Wasielewski. His work including synthesizing and characterizing electron deficient small molecule organic materials.
