Mr. Holler's practice focuses on intellectual property litigation, with emphasis on patent infringement suits arising under Hatch-Waxman Amendments to the Food, Drug and Cosmetic Act.
Mr. Holler has experience representing clients in proceedings before the United States District Court for the District of Delaware and the District of New Jersey. Mr. Holler has experience in a number of stages of litigation, including pre-suit strategy development, fact and expert discovery, and the pre-trial and trial phases of federal litigation.
Mr. Holler has experience with respect to a wide range of pharmaceutical technologies, including with respect to small molecule chemistry, pharmaceutical compounds, pharmaceutical formulations, polymorphic forms of active pharmaceutical ingredients, immediate and extended release dosage forms, inhalation dosage forms and devices, and pharmaceutical dosing methods.
Opinion Work and Patent Counseling
Mr. Holler is active in the firm's patent counseling practice group. In this context, Mr. Holler has prepared a number of detailed statements in support of different regulatory filings, including with respect to Abbreviated New Drug Applications.
Representative Matters
Mitsubishi Tanabe et al. v. Lupin Limited et al. (D.N.J.): Represented Lupin Hatch-Waxman litigation concerning patents related to INVOKANA®. Case resolved by settlement with favorable terms for client.
Previous Experience
Prior to joining Rakoczy Molino Mazzochi Siwik LLP as an associate, Mr. Holler was a summer associate at the firm. During law school, Mr. Holler served as a judicial extern for the Honorable Sanjay T. Tailor in the Illinois Circuit Court of Cook County.
