Litigation

Mr. Hauer's practice focuses on intellectual property litigation, with emphasis on patent infringement suits arising under the Hatch-Waxman Amendments to the Federal Food, Drug, and Cosmetic Act. He has also represented companies in various other complex matters, including antitrust, trade secret, tortious interference, copyright, and trademark.

Mr. Hauer is experienced in all aspects of litigation, including drafting pleadings, taking and defending fact and expert depositions, supporting temporary restraining order and preliminary injunction proceedings, as well as drafting Motions to Dismiss, Daubert briefs, and Summary Judgment briefs. Mr. Hauer has assisted with multiple bench trials, including conducting expert witness direct examinations, supporting expert and fact witness cross-examination, drafting trial demonstratives, and preparing pre- and post-trial briefing. Mr. Hauer has additionally assisted with appellate briefing before the Federal Circuit and the United States Supreme Court.

Practice Before the U.S. Patent and Trademark Office

Mr. Hauer is registered to practice before the United States Patent and Trademark Office and also has significant experience with inter partes review proceedings, including preparation of IPR petitions and expert declarations. Mr. Hauer has also argued a patent prosecution appeal before the PTAB.
